Justice Scalia and US Supreme Court Denied me Justice!











On Friday February 12, 2016, President Obama told Ellen that her courage to let world know her truth changed hearts and minds about the gay community. My book can change hearts and minds on racism in this country. Nothing happens by chance it is divine.

NO MARCH, NO PROTEST, AND/OR SPEECH Will Improve African-American Lives!

                                         


In their own words recorded in this video by me on October 16, 2011, in Washington, DC, President Obama and Rev Al Sharpton acknowledged ACTION and VOTING are the methods to CHANGE America.

According to the NAACP website on August 28, 1963, Leaders from civil rights, labor, immigrant rights and social justice organizations will speak after the march. Fifty years later the National Action to Realize the Dream March is scheduled for August 24, 2013, in Washington, DC.

                                    

I will not be attending the August 24, 2013, march in Washington for two reasons.  One I can’t afford to attend. Secondly, NO MATCH, NO PROTEST, AND/OR SPEECH Will Improve African-American Lives during this current political climate.That is a simple FACT!

In a Huffington Post article titled “Why We Need to March …Again” NAACP President Jealous stated in part: We need you there to help us gain a critical mass of voices, and prove once again that organized people can beat organized money any time. I respectfully disagree with Jealous.

I believe that those who are honest with themselves must accept the fact that at this time in our nation’s history “NO MARCH, NO PROTEST, AND/OR SPEECH is going to improve the lives of the poor, unemployed, underemployed, African-Americans, or the disadvantage in this country. Our time, MONEY, organization skills, and political activity should be spend trying to overcome the barriers to voting. Since President Obama’s historic 2008 election the Republican Party in general and Republican governors in particular have supported and passed voter registration identification laws to deny minorities, working class citizens, and the poor their constitutional right to vote.

If the NAACP and Rev Al Sharpton believes that a large gathering of people of all races, economic status, and sexes will change the mind set of those who oppose equality I present exhibit A – Picture of approximately two million people attending President Obama’s inauguration.

                                           




I would also remind Sharpton of his outstanding October 15, 2011, march in Washington DC for Jobs and Justice which I attended.

On October 8, 2012, I answered President Obama’s campaign and his organization OFA (Organization for America) call for volunteers. I volunteered for the Vote Corps program and report at my own expense to Norfolk, Virginia to help him win the 2012 Presidential Election.

I volunteered for the Vote Corps program and worked 31 days because President Obama is our Hope attaining a measure of equality unequal during any time in this nation’s history. I also believe that President Obama’s re-election would forever CHANGE America for the better.

On August 16, 2013, Lee Daniels' The Butler movie which stars Oprah and Forest Whitaker opened in theaters in America. Prior to the release date of the movie on August 12, 2013 CNN Suzanne Malveaux Digging Deeper into Lee Daniels' The Butler movie interviewed actor Forest Whitaker and Director Daniels. Malveaux’s interview drives home the fact that a cycle and circle of racism still continues in America.

At the 7:50 mark and 8:37 mark in the video they discussed the current state of race relations in this country, Trayvon Martin, Supreme Court Voting Right Act of 1965 ruling, and the cycle of racism that we have been trying to break as a race of people. Director Daniels voiced irony of realizing that President Johnson was responsible for the Voters Right Act of 1965 and finding out the Supreme Court’s ruling on Voting Rights Act of 1965 after filming that part of the movie.
Whitaker believes that the cycle and circle is still going on. He believes that a dialogue can help break the cycle. I agree with Whitaker that cycle of racism is still happening but I believe that an honest dialogue on racism and ACTION from the executive branch of our government is needed to end the cycle.

What Americans especially African-Americans need NOW is concrete MEASURABLE action from President Obama. He can break part of the CIRCLE/CYCLE of racism by having the courage to boldly address and take ACTION to strengthen Title VII of the Civil Rights Act of 1964. The Act itself is a landmark piece of legislation in the United States that outlawed major forms of discrimination against blacks and women, and ended racial segregation in the United States.

Title VII of the Civil Rights Act of 1964 protects individuals against employment discrimination on the bases of race and color, as well as national origin, sex, and religion. Title VII applies to employers with 15 or more employees, including state and local governments. It also applies to employment agencies and to labor organizations, as well as to the federal government. Employment discrimination is a major reason that African-American unemployment rates is double that of Whites in some parts of America. It is also a reason that many African-American teenagers are unemployed and many African-American adults are either unemployed or underemployed.

President Obama has the same POWER, opportunities, and resources that were available to President Johnson when he signed the Civil Rights Act of 1964. He also has the "dream" and the office of the Presidency to make real changes in our lives to include justice for all of America’s citizens. Additionally, he has already addressed and corrected part of the Title VII of Civil Rights Act of 1964.

On January 29, 2009, President Obama signed the Lilly Ledbetter Fair Pay Restoration Act.  According to the New York Times: “In signing the bill, Mr. Obama said that it sends the message "that there are no second class citizens in our workplaces, and that it's not just unfair and illegal, it's bad for business to pay someone less because of their gender or their age or their race or their ethnicity, religion or disability."



President should address employment discrimination once again because it is the RIGHT thing to do. I am an African-American female victim of employment discrimination who likes Lilly Ledbetter was denied justice by the Supreme Court of the United States for employment discrimination. I hope and pray that President Obama will take a similar interest in my case and act in a similar fashion. I hope that he doesn’t let politics prevent him from using my case to address Title VII of the Civil Rights Act of 1964, because my experience occurred in New York and involves Democrats Eliot Spitzer and Governor Andrew Cuomo.

                                       





  The salutary purpose of summary judgment and the rights of all Americans to fair and equal justice can both be accomplished with a well written and defined amendment to the Civil Rights Act of 1964. Amending the Civil Rights Act again would prevent one judge from having the absolute power to grant summary judgment motions that dismiss Title VII (discrimination and retaliation) cases.

Was Sister Diana Sailor Denied Heart Treatment $10,000 LifeVest Because of Lack of Insurance Coverage?


NOTE: I found out that Diana Sailor, who is 45 years old, was discharged without the LifeVest on Sunday August 18, 2013, during a 8:35 pm telephone call. While I was on the phone I received a call from the sister of my friend Jimmy Robinson. During that 9:13 pm telephone conversation I was informed that Jimmy who had heart problems died of heart attack in a car earlier on Sunday August 18, 2013.


On August 16, 2013, my sister Diana Sailor was discharged from Florida Hospital Tampa without a life saving LifeVest which was prescribed by her treating physician on August 9, 2013.  A LifeVest is a personal defibrillator worn by a patient at risk for sudden cardiac arrest (SCA).  It monitors the patient's heart continuously. If the patient needs it delivers a shock treatment to restore the patient's heart to normal rhythm without bystander intervention for a high-risk heart patients awaiting implants.

According to another sister Diann was told by the physician that if she left the hospital without the LifeVest her chance of surviving was one (1) percent. Diann who is a Licensed Practical Nurse (LPN) was also told that she is totally disabled and CAN'T WORK.

During her ten day stay in the hospital payment of the $10,000 cost of the vest was discussed. Diana was told that she would receive the LifeVest  although she didn't have insurance that would cover the cost of the LifeVest or the $500.00 down payment needed for a payment plan .

On the day that she was to meet with a specialist to receive instructions on the LifeVest another doctor examined her and told her that she would not need the LifeVest. Although Diann cried and stated that she was scared to leave the hospital without the vest she was discharge on August 16, 2013, without the life saving devise. Was she discharged and sent home with prescribed medications and not the LifeVest because of the COST of the LifeVest, no insurance coverage, and/or that her LIFE wasn't viewed as WORTHY of being saved?

Please investigate and/or donate the money needed for my sister to obtain much need HEALTH CARE TREATMENT.

Thanking God for Obamacare: Uninsured Floridian Sister with Defective Heart Needs "Obamacare"

My forty-five year old sister Diane is one of the many Florida residents who don’t current have health insurance. On August 9, 2013, she had a heart procedure at a hospital in Tampa, Florida. The surgical procedure was done to correct/address damage done to her heart caused by steroids given to treat chronic asthma.


Diane who is a Licensed Practical Nurse (LPN). Her treatment includes having her leave the hospital with a LifeVest which automatically provides monitoring and delivers electrical therapy without bystander intervention for a high-risk heart patients awaiting implants.


Diane and other Americans who suffer from life-threatening heart problems life and health is important to their love ones as Dick Cheney’s life is to him and his family. Cheney received the best medical treatment available in the world for his heart problems and eventually received a heart transplant at age 71 .
I don’t know what my precious sister’s future will be but I do know that Gods holds the future. I am thankful that Affordablce Health Care Act (Obamacare) is the law of the land. I am so happy that Florida Republican Governor Scott has reversed his stance on Obamacare which will make health insurance coverage available to 1.3 million Floridians.

I had a heart health scare earlier this year. Unlike Diane I had health insurance and extensive testing revealed that I didn’t have a defective heart. My own experience and that of my sister had made me believe more than ever that every American deserves to have affordable health care as a RIGHT and not a privilege.

On 7/20/13 President Obama asked "How do we learn some lessons from this and move in a positive direction?" "But beyond protests or vigils, the question is, are there some concrete things that we might be able to do. There has been talk about should we convene a conversation on race. I haven't seen that be particularly productive when politicians try to organize conversations. They end up being stilted and politicized, and folks are locked into the positions they already have. On the other hand, in families and churches and workplaces, there's the possibility that people are a little bit more honest..." 

Trayvon Martin's verdict was an unjust criminal verdict but African-Americans have suffered and continue to suffer from unjust CIVIL verdicts and court rulings/decisions too.

My hope is that this book and conversation will  result in action by Mr. Obama who is our dear president and great leader of the free world.

One form of racism Employment discrimination can be addressed and curbed by President Obama with an executive order. He can amend the Civil Rights Act of 1964 again like he did in the Lilly Ledbetter case. Amending the act again will allow victims of employment discrimination to have juries and not JUDGES decide if their employers discriminated and/or retaliated against them.

President Obama DO IT for Trayvon, African American Racism Victims, and ME: Amend Civil Rights Act of 1964 AGAIN








President Obama has supported and/or not enforeced and signed bills that have made real changes in the lives of women, the gay community, military families, and Hispanics. Afrian-Americans need real positive changes in our lives too.

Rally of Striking Houston Janitors in 100 Degree Temperature for $10.00 Hour Pay


Updated 8/14/2014 President Obama needs Hispanic and African Americans to unite and vote on 11/4/2014 like most of us did 11/6/2012.  If we do we will not only save his legacy 2009-2015 but we will save ourselves and our children.  Immigration Reform, equality, jobs, education, Supreme Court appointments, a future Hispanic American being elected as President all hang in the balance. We can have it all if we volunteer, GOTV, Vote, and donate for the Democratic Party.



Houston janitors are striking to increase their pay from a top wage of $8.35 per hour to $10.00 per hour. On August 1, 2012, my life’s path crossed the lives of these hard working men and women. Prior to my arrival and at a different location several of the people participating in the match and rally were arrested during the event. Therefore I attended the rally and videotaped part of it to give their cause and poor people a voice. My ongoing commentary in the video includes encouraging and discussing the importance of voting for Democratic candidates.
The fact that the janitors clean the offices of corporations and banks like Shell Oil, Wells Fargo, and JP Morgan had to strike for $10.00 a hour pay is unacceptable to me.  Despite record profits and inflated CEO pay, janitors who clean Houston's office buildings are paid less than $9,000 a year—less than half the poverty level.

The Houston janitors are members of Service Employees International Union “SEIU.” The event, which occurred when the temperature was 100 degrees, included members of the SEIU from across the nation to show their support of the Houston janitors who engaged in one day strikes this year before going on strike the night of July 10, 2012.

According to one of the speakers at the rally SEIU union will be sit down at the bargaining table with the Area Contractors Association on August 2, 2012.

President Obama, Lilly Ledbetter, and Vera Richardson



On January 29, 2009, President Obama signed the Lilly Ledbetter Fair Pay Restoration Act. According to the New York Times: “In signing the bill, Mr. Obama said that it sends the message "that there are no second class citizens in our workplaces, and that it's not just unfair and illegal, it's bad for business to pay someone less because of their gender or their age or their race or their ethnicity, religion or disability."

I hope and pray that President Obama will take a similar interest in my case and act in a similar fashion. I hope that he doesn’t let politics prevent him from addressing racial employment discrimination that involves Democratic Party members Eliot Spitzer and  Governor Andrew Cuomo.

As of today’s date Andrew Cuomo has ignored my pleas for justice and peace. I hope that as leader of the Democratic Party Pres Obama contacts Cuomo and request that he investigates my case, the unjust denial of the appeal of my disability retirement application, and makes me whole by reversing that denial and reward me much needed back pay from that appeal.

Like Lilly, Vera Richardson, was a victim of employment discrimination. Ledbetter and women groups were encouraged by the signing of the bill named in her honor. Vera and African-Americans victimized by unlawful employment discrimination will be encouraged and motivated to participate in the November 6, 2012, presidential election if the defendants and attorneys on record in Richardson’s case and tens of thousands of other employment discrimination cases are held accountable for their unfair and illegal actions.

THE HELP Must See Movie for African-Americans



I am encouraging African-Americans to reconsider their decision not to support of even view the movie "The Help."  The movie is current available on DVD and Blu- ray and has been nominated for Sag and Golden Globe awards including best actress for Viola Davis.

As a race of people African-Americans are currently losing ground on hard fought battles for equality, jobs, housing, education, and voting rights. We must use our God given talents and common sense to save ourselves. Since the election of this nation's first "Black" president Barack Obama many in politics are openly stating "that they want to take their country back."

The Help is a great tool to use to remind us and our children of some of the possible implications of cries by white politicians to take their country back mean. It is also a tool to use to encourage and educate our children and their friends to strive to achieve academic, political, personal, and financial success from an early age. Lastly is also an excellent tool to motivate us to put on your matching shoes and work to re-elect President Obama in order for him to continue his vision of moving this country forward by achieving equality and justice for ALL Americans including us.

I NEED AND WANT “OBAMACARE”

I am African-American and one of the tens of millions of poor people in a depressed economy. I am struggling on a fixed income because of an illness of work-related depression and anxiety.



I broke my shoulder bone after falling on a sidewalk in Houston, TX. My injury required an emergency transport by ambulance to a local ER and surgery. My co-pay before the operation would be performed was approximately $900.00 with Medicare Part A and B.

Calling out Anderson Cooper, Andrew Cuomo, Eliot Spitzer and CNN




Keeping Anderson Cooper, Eliot Spitzer, Andrew Cuomo and CNN Honest.  On September 28th and 29th 2010, Anderson Cooper in his Keeping Them Honest segment covered the story of Michigan Attorney General Mike Cox’s failure to discipline and/or terminate Andrew Shirvell, Asst. Attorney General of Michigan for “bullying” and harassing Chris Armstrong who is gay and the President of University of Michigan.


I am going to hold CNN and Anderson Cooper to the same standard. Why isn’t Anderson Cooper or CNN Eliot Spitzer current employer demanding that Cuomo investigate, discipline and/or terminated Russo for his actions that have left me broken emotionally and financially? Why did CNN hire Spitzer although my factual allegations which I have posted numerous times on CNN I-Report site could be easily investigated and substantiated?

Under Eliot Spitzer supervision Mike Russo, Asst NYS Attorney General filed several perjured declarations that denied this writer an African-American woman her right to have a jury trial during my Title VII employment discrimination and retaliation lawsuit. (97-cv-818(E). Why hasn’t CNN or Cooper featured my story that includes the fact that Eliot Spitzer in his role of New York Attorney General employed Mike Russo who is currently Acting Attorney General in charge of the Regional Office? Why is Mike Russo still employed by Andrew Cuomo?

On May 28, 2005, an Erie County, New York Assistant District Attorney reviewed my documentation of multiple perjury allegations against New York Attorney General's Office and various New York employees. After his reviewed he informed me that I should contact the New York State Attorney General Office because my allegations of perjury were supported by the documents that I submitted to his office. I informed him that New York State Attorney General’s Office including Eliot Spitzer was aware of my case and the factual perjury allegations.

The Asst DA told me that I should contact the United States Justice Department. I contacted the United States Justice Department and at their telephone request e-mailed extensive documentation on May 29, 30, and 31, 2005. In July 2005 Jane Wolfe and Allison Gioia both US Justice Department attorneys, reviewed my perjury allegations and direct evidence supporting the allegations and agreed with the Erie County Asst DA.

The United States Justice Department attorneys informed me that they were referring my case to the FBI for an investigation. I telephoned the FBI and was told that they could not confirm or deny the fact that my allegations were being investigated because of confidentiality rules. The FBI and United States Justice Department did not charge anyone with perjury in my case.

Could the answer be that Spitzer, Cuomo, the United States Justice Department, and CNN have a double standard because I am African-American?

Officer Green's Racial Experience at NYS Albion Correctional Facility

Several African-Americans at Albion CF experienced and complained of racial and sexual employment discrimination. One of the African-Americans females who experienced discrimination at Albion CF was Correctional Officer Debbie Green. Debbie’s story: “Officer Green was original from the South. She transferred to Albion CF after her husband retired from the New York City Transit Authority. She moved to Albion, New York in order to live out her dream of living in a rural area.

Green told me in my capacity as her real estate agent that she wanted to purchase a house that had a wood stove and a large yard in Orleans County.  Her dream included planting a garden in her own backyard. I showed Green several houses in an effort to find one to fulfill her dream.

Officer Green was an older seasoned officer who had more seniority that most of the officers working at Albion. If my memory serves me correctly Green had been employed with NYSDOCS for sixteen years when she arrived at Albion.

Green gave one hundred percent to any and all job assignments. She worked as a resource officer because she was not eligible to bid for a permanent job assignment. The Collective Bargaining Agreement between Counsel 82 Union and NYSDOCS required that officers had to be at a facility for a certain number of days in order to bid on a job assignment.

All bids were awarded based on seniority in the New York State Department of Corrections. If a bid required a particular sex of an officer that bid would be awarded based on seniority of the required sex.

The Medical Transportation A Team bid was a highly desired assignment at Albion CF. Officers wanted the A transportation bid because it was one of the few job assignments were the officers worked Monday thru Friday and had weekends off.

After waiting the required time period per the union contract Officer Green submitted a bid for the Medical Transportation A Team. Based on sixteen years of seniority Green was awarded the female designated bid of the Medical Transportation A Team.

Officer Green like many officers at Albion worked swaps with other officers in order to have additional days off. One day Officer Green was working the 3:00 to 11:00 p.m. shift on a swap. I don’t remember the exact events that took place but I do know that Green faced serious disciplinary charges after her encounter with a white male sergeant that she classified as a racist.

Council 82 union represented Officer Green during the disciplinary hearing(s). Green told me that she lost the first hearing because the sergeant involved in her incident lied during the hearing.

Albion staff offered to settle her case by giving Green a formal counseling. She refused the formal counseling offer because she had never been informally or formally counseled during her entire employment with NYSDOCS. She also refused to accept the formal counseling offer because she said she had not done anything wrong.

Debbie Green appealed her case all the way to arbitration. It was a very cold day in December when the arbitrator’s decision was received at Albion CF. Green lost her appeal during the arbitration process. She was suspended for thirty day without pay and fined $1,500.00.

On that cold December day Officer Debbie Green was escorted to the front gate and put out of the prison by a security supervisor and a local Council 82 official. Green left the facility crying as she walked to her apartment in the snow. One of the black officers who witnessed Green being escorted out of the prison told me that Green refused Albion’s staff offer to call her husband for a ride back home. (Her husband had dropped her off at 6:45 a.m.) Green later told me that she cried because she felt defeated and deeply wronged by Albion’s supervisory staff.

For the first time that I could remember the fifty-five black officers at Albion were finally fed-up and outraged. They voiced their concern that Green’s ordeal was racial motivated and that if this could happen to Officer D. Green it could happen to any of us.

Many of the black correction officers at Albion telephoned each other at work and decided that as a group we would pay the $1,500.00 fine for Officer D. Green. I was one of four or five black officers who volunteered to collect twenty-five dollar from each black officer at Albion CF in order to pay Officer Green’s fine.

January 7, 1996, my peace officer's badge and NYSDOCS ID card was stolen at Albion CF.  After trying unsuccessfully for several days to get my departmental items replaced my doctor determined that I was once again disabled from work-related anxiety and depression. (I had missed three weeks of work because of the same illness after a August 26, 1995, hostile work environment experience with Sergeant Reed).

While I was out of work due to work related depression I was notified that black officers had called the local National Association for the Advancement of Colored People in Orleans County.
On March 9, 1996, Gwendolyn Wiley, President local National Association for the Advancement of Colored People (NAACP) in Orleans County met with Black correctional officers. The meeting was held after the officers requested the meeting to discuss racial discrimination at Albion CF. At the officers’ request the meeting was held secretly at a local church in Albion.

Due to the nature of shift work approximately 20 black officers attended the meeting. Officer Debbie Green and I were two of the 20 black officers present. In an effort to disguise the true nature of our group and because of the fear of retaliation by Albion supervisors we called ourselves “the Focus Group.”

We heard story after story of discrimination and disparate treatment of black staff at Albion CF. Many of the officers felt that incidents of racial discrimination had increased after Superintendent Andrews (a black female) was assigned to Albion.

During the meeting Green thanked us for giving her the $1,500 to pay her fine. She told us that she tried unsuccessfully to get a private attorney to appeal the decision of the arbitration board. After her experience she transferred out of Albion CF and returned to a New York State correctional facility in downstate New York. Due to discrimination at Albion Correctional Facility Green was suspended without pay, fined $1,5000, and abandoned her dreams of buying a home in Orleans County, living in a rural setting, and having a garden.
                   NYS DIVISION OF HUMAN RIGHTS FLAWED INVESTIGATION

The Final Investigation Report of  Julia Day of the New York State Division of Human Rights contains a summary of her interview with the two African-Americans female officers at Albion CF. Day conducted the interviews while she was investigating my formal complaint of employment discrimination with that agency. Although both of the officers confirmed the fact that females were treated differently than male officers at Albion Day didn't interview additional female or African-American male officers at the prison.

On May 12, 1997, Day determined that there was no probable cause to support the allegations in my complaint. On November 17, 2000, Eliot Spitzer filed Julia Day's declaration signed on November 15, 2000, in support of the Defendants New York State Departments of Correctional and Civil Services summary judgment motion.

The  March 19, 1996, minutes from our meeting with the local NAACP shows that the Focus Group agreed to meet again. I don’t know if the Group met again because I wasn’t notified of another meeting.
