I never imagined the Republicans Racism to President Obama would be active 4 years after he WON. We can't let them (Racist) win. Blacks and Hispanics can't continue to live in FEAR year after year or elections after elections. 


I know that God created me for just this time in our nation's history. My divine purpose is to shed light on AMERICA'S racism. That purpose included appealing a Civil Rights Act of 1964, Employment and Discrimination case to the Supreme Court of the United States without an attorney.


One of the reason I had to represented myself (Pro-Se) the district court judge Elfvin denial of four motions seeking appointment of counsel. My divine purpose including writing a 364 book that includes direct evidence uploaded in the it as pictures.

PRAY: President Obama Seizes Charleston Domestic Terrorism Horror and Take Executive Action Against Racism


First of all  I want to thank President Obama for being this nation first African-American President and one the best presidents to occupy the White House.



In this post President Obama is referencing gun violence and gun control. That's a good thing but I also believe that he should siege the Charleston terrorism  moment and finally look racism in the face and not blink. He should discuss, address, and tell nation that he is going to take action to help and protect African-Americans from racism.

                       



   TIME FOR PRESIDENT OBAMA TO TALK ABOUT RACISM AND TAKE ACTION

We can't lose sight that  he can also talk about and do something about the role employment discrimination plays in the cycle of RACISM. I believe President Barack Obama can and should amend Title VII of the Civil Rights Act 1964 again with an Executive Order.  Amending Title VII of CRA 1964 again like he January 2009, for Lilly Ledbetter will prevent one judge from unjustly dismissing Employment Discrimination. Many Title VII case including my case are unjust dismissed based on perjured or flawed summary judgment motions.

Victims of unlawful discrimination shouldn't have their cases unjust dismissed at the district court based on one federal judge absolute authority to unjustly dismiss Civil Rights Act of 1964 Title VII cases based on summary judgment motions.  Once again President signed an Executive Order for Lilly Ledbetter and women. Will he have the courage to sign another Executive Order for me and other African-Americans employment discrimination victims?

The salutary purpose of summary judgment and the rights of all Americans to fair and equal justice can both be accomplished with a well written and defined amendment to the Civil Rights Act of 1964. Amending the Civil Rights Act again would prevent one judge from having the absolute power to grant summary judgment motions that dismiss Title VII (discrimination and retaliation) case.

African-Americans we CAN Change America By SAVING Ourselves from RACISM!


                         

The highly qualified Harris County African-Americans pictured above were defeated as judiciary candidates on November 4, 2014. Harris County has more registered Democrats than Republicans and Independents combined but they didn't vote.

I believe that during the November 4, 2014, mid-term elections African-Americans behaved like the children of Israel after they were delivered from slavery. Exodus 14:12 of King James Version of the Bible: “Is not this the word that we did tell thee in Egypt; saying Let us alone, that we may serve the Egyptians, than that we should die in the wilderness.”

After witnessing all of the January 20, 2009, conspired opposition to President Obama by the Republican Party, many minorities felt exhausted from defending President Obama. Like President Obama they didn't know about the secret 2009 pledge to vote NO to EVERY agenda item of the first African-American president. We couldn't understand him using most of his first term trying to get Republicans to support and vote for "Obamacare."

Hispanic Americans got angry and didn't vote in record numbers needed to retain the Senate and take back the House. Their  reason for not turning out to vote  many didn't understand the necessary politics of waiting until after the midterms to take Executive Action on Immigration Reform.

President Obama said that change wouldn't come easy in this country and the November 2, 2010, and November 4, 2014, midterms proved that fact. President Obama hasn't gotten weary and/or given up and we can’t get weary and give up either.

Murder victims Trayvon Martin, Mike Brown, Eric Gardner, African-Americans, Hispanic-Americans, the poor, under educated, and women need President Obama and educated and/or successful African-Americans to continue fighting for his visions of Justice and Equality for all Americans.

We must trust God and know that just like He delivered the children of Israel He will protect and deliver us too. We must vote in every election as if it’s a presidential election. More importantly, we MUST have the race/racism conversation that President Obama requested after the Ferguson verdict.

On November 4, 2008, Senator Barack Obama was elected as this nation first African-American president. On January 29, 2009, President Obama signed the Lilly Ledbetter Fair Pay Restoration Act.  This was the first act signed into law by President Obama.

According to the New York Times: “In signing the bill, Mr. Obama said that it sends the message "that there are no second class citizens in our workplaces, and that it's not just unfair and illegal, it's bad for business to pay someone less because of their gender or their age or their race or their ethnicity, religion or disability."

I am an African-American female victim of employment discrimination who likes Lilly Ledbetter was denied justice by the Supreme Court of the United States for employment discrimination.  I hope and pray that President Obama doesn’t let politics prevent him from using my employment discrimination case to address and amend Title VII of the Civil Rights Act of 1964, because my experience occurred in the State of New York and involves Democrats Eliot Spitzer and Governor Andrew Cuomo.

The salutary purpose of summary judgment and the rights of all Americans to fair and equal justice can both be accomplished with a well written and defined amendment to the Civil Rights Act of 1964.

Amending the Civil Rights Act again would prevent one judge from having the absolute power to grant summary judgment motions that dismiss Title VII cases. Amending the Act again will also make the guarantees of both the 13th and 14th amendments of the United States Constitution and the protections under Title VII of the Civil Right Act of 1964 a living reality for all Americans. All Americans are entitled to due process and equal protection under the law.

BLACK PEOPLE STOP DOING STUPID SH-T: Don't Protest at NIGHT PERIOD!



Please don't do stupid s__t like marching at night. Please stay off the street at night.  Don't give Coburn and Republican Party what what they want. They may start the violence and say African-Americans started it. 


Blacks shouldn't march or protest at night. Republican Senator Coburn who met with his party on 1/20/09 (night Barack Obama took oath) and conspired to obstruct his presidency wants anarchy and violence. On November 20, 2014, Coburn who is leaving the Senate because his cancer has returned "predicted" call for violence all over this nation. In his interview with USA today he referenced Ferguson just like he did on Morning Joe Show


We can't win nor do we want a race war. Our lives are in our hands and Jesus hands. Listen to this passionate insight about what is happening in Ferguson and pray. Please pray for our nation and specific for Jesus to protect President Obama from all harm domestic and foreign.

Do you believe the nation will be shocked and respond to the violence the same way they did during Jim Crow and the Civil Rights movement? The refusal of all the major networks ABC, NBC, CBS, and FOX to allow President Obama 15 or 20 minutes of air time to tell nation details of his Immigration Reform policy guarantees that history will not repeat itself. Only negative images or videos that support the narratives that BLACK people are responsible for the violence, unlawfulness, and riots will be featured and discussed by the media.



I don’t want to preach but many of you who are matching and protesting failed to either register to vote or didn’t vote in 2010 and again in 2014. Not voting on November 6, 2014, and/or like some activist in Houston, TX telling Blacks not to vote was a critical mistake.

I believe that many eligible Hispanic voters didn't register because of fear of exposing their mixed family members. Now that Barack Obama has used Executive Orders that should relieve some of those fears Texas Democratic Party should start massive end of year drive to register those potential voters. I also believe that other states should do the same thing.

Proactive actions we can take to honor Mike Brown and deny the Republicans the White House in 2016 includes but aren't limited to: 1: Getting eligible Hispanic voters registered during daylight hours in cities across this nation.  2. Raising money and establishing methods to identify and get state issued voter identification cards for those who need them.
Volunteering at your local county and state Democratic Party headquarters today. Use your energy to help people like these pictured Harris County democratic female judiciary candidates. All of them lost on November 6, 2014, but you can help them become judges in future elections. 

Don't give up and don't lose HOPE. JESUS gave us President Obama and Eric Holder to bring equality and justice to all Americans including Mike Brown. It will be hard to change America to a more just nation. Change will happen if Blacks realize that we are in the fight for our lives and our children's lives. Blacks must make better decisions and matching and/or protesting at NIGHT in any city in America is STUPID!

Will Eight Million Obamacare Enrollees Neutralize Senator Cornyn’s Willie Horton Ad?




 Each time I viewed SENATOR John Cornyn's 2014 "Astonishing" primary ad on television I cringed. The ad prominent displayed of President Obama's black face seems to be an attempt to make him look like a criminal and/or a menacing black man.

 I believe that the purpose of the Cornyn's campaign ad is the same as the Willie Horton ads discussed in "The Willie Horton ad revisited 25 years later" post by the Grio. The Willie Horton ad "represented a new low in race-card politics, and the manipulation of white fear of black criminality—and an irrational and visceral hatred of black people in general— to win elections."

I hope that the fact that 8 million Americans signed up for the Patient Protection and Affordable Care Act aka "Affordable Care Act" "Obamacare" will end Republicans racist political campaign ads. More importantly I hope that Cornyn and the Republicans will stop using images of the president of the United States of America, Mr. Obama, as a menacing figure to energize its supporters.

Racism? Yes Eric Holder ONLY Attorney General EVER held in Contempt of CONGRESS

On June 20, 2012, I watched twenty-three Republicans all who appeared to be white Americans on the House Oversight and Government Reform Committee vote to recommend that Attorney General Eric Holder, an African-American, be cited for contempt of Congress. Seventeen Democrats five who appeared to be African-Americans voted against the unprecedented measure. Many will argue that this is a legal and/or political matter and nothing more. I believe differently. It was a racist act. Representative Cummings was one of the five African-Americans on the committee. Watching his face as he voted and watched others vote broke my heart. It broke my heart because of the emotional, spiritual, and financial pain that racism caused me as a child and an adult. Andrew Cuomo Please Grant me Entitled Disability Retirement Benefits!

After reading this post please call Governor Cuomo at 518-474-8390 and tell him to use an Executive Order to give me entitled disability retirement benefits. Black New York citizens deserves a governor who will not only support equal opportunity for all of its citizens but one that will correct past racial injustice.

I am entitled to  Disability Retirement because of Judicial Estoppel. The legal doctrine of  Judicial Estoppel means a party is not allowed to present a different legal argument that is contrary to a previous legal argument that results in a favorable decision for that party in another legal proceeding.

The Defendant NYS Department of Civil Service disapproved my disability retirement application in June of 1997.


I filed my employment discrimination lawsuit October 15, 1997, and was FIRED in retaliation for filing  the lawsuit at the close of business on November 2, 1998.



The Defendants in my Title 7 (employment discrimination) Civil Rights Act of 1964, as amended case should not have prevailed in claim that I fired because my medical condition rendered me incapable of doing Correctional Officer duties. Please note in June 1997, they determined that I wasn't disabled and not entitled to disability retirement.

My claim that I was fired November 2, 1998, in retaliation for filing October 15, 1997, lawsuit was rejected by district court, Second Circuit Court of Appeals and Supreme Court of the United States.


I have exhausted all avenues of judiciary redress including appealling my case without an attorney to the Supreme Court of the United States. Governor Andrew Cuomo is my only hope for peace, entitled disability retirement, and/or justice.


 


In an order dated May 25, 2001, now deceased Judge Elfvin, granted the Defendant's summary judgment motion in its entirety.

                  

                  

See Gould Declaration filed November 17, 2000. The evidence amply supports this conclusion and, as will be discussed more fully below, plaintiff’s references to a retaliatory motive behind her discharge based on race and sex are at best, conclusory assertions."  

"Turning first to plaintiff's claim regarding retaliatory discharge it is plain that  there are no facts in the record upon which such allegation can succeed. Assuming that plaintiff has set forth prima facie case of rretaliatory discharge she fails to articulate any reason why the proffered justification for terminating her was pretext - viz that her medical condition rendered  her incapable  of performing the duties of a correctional officer. (Purposely typed and copied from origin court order)
                                                            
NOTE: The judge cited Gould's perjured declaration in granting the Defendants summary judgement motion. At the bottom of Gould perjured declaration you can see the NYS Attorney General's name and fax number. Since Spitzer's staff knew that I was terminated in November 2, 1998 are they guilty of violating my civil rights or willfully engaging in a conspiracy with Lee Gould by submitting the perjured declaration for him to sign? 





During the final appeal hearing proceeding of my disability retirement application in 2002 NYS Department of Civil Services  argued that I was not entitled to disability retirement because I wasn’t disabled. Their 2002 legal argument (position) contradicted their legal summary judgment argument. An argument that resulted in Judge Elfvin’s favorable dismissing my entire case and ruling that my termination was not retaliatory.







In May of 2005 I contacted the United States Justice Department and at their telephone request e-mailed extensive documentation to support the fact that Eliot Spitzer filed 7 perjured declarations. The perjured declarations were filed in federal court with Spitzer summary judgment motion. All of the declarations in the following picture contained perjured (false) statement(s). 


In July 2005 Jane Wolfe and Allison Gioia both US Justice Department attorneys, reviewed my perjury allegations and direct evidence supporting the allegations. The United States Justice Department attorneys confirmed the perjury and informed me that they were referring my case to the FBI for an investigation. 

I telephoned the FBI and was told that they could not confirm or deny the fact that my allegations were being investigated because of confidentiality rules. The FBI and United States Justice Department under President George W. Bush leadership did not charge anyone with perjury in my case.


In 2008 I contact then Attorney General Andrew Cuomo after reading that he had increased the size of New York State Attorney General's Civil Rights Bureau.  I was hopefully that he would take the necessary action to make me whole from NYS Attorney General filing perjured declarations in court.


Governor Cuomo and New York State Departments of Correction and/or New York State Department of Civil Services can make me whole by reversing the unjust denial of my disability retirement application. Cuomo can use an executive order or support a bill that will give me entitled disability benefits from the date of my original application.

Other options for Cuomo and/or New York State Defendants named in my lawsuit to make me whole includes paying me back salary for the retaliatory failure of Albion CF staff to interview and/or reinstate me to the July 19, 1996, position of Supervisor of Inmate Grievance Program at Albion CF, and/or paying me the $3,000,000 that I demanded in my Title VII Civil Right Act of 1964 lawsuit.

NOTE: In 1998 I submitted a settlement offer to the Defendants.  I offered to settle my lawsuit for $50,000 and the rewarding of my disability retirement.

President Obama WON Election: Racist GOP Obamacare Vote Sending Fear not Experienced Since November 6, 2012










The day after the Novemember 6, 2012,  presidential election I retuned to OFA Norfolk office. I made the emotional video in this post with the HOPE that the election was over and that the GOP would finally put this nation first and accept the fact that Barack Obama was indeed the choice and duly elected president of the the greatest democracy on earth.  I was wrong.

In 2008 President Obama said that change wouldn't come easy in this country and the September 20, 2013 vote by the GOP to fund the government only if President Obama signature accomplishment The Affordable Health Care Act "Obamacare" is defunded proved that fact.

President Obama can't give in or even entertain this clearly RACIST position that the GOP and Speaker Boehner has taken. The poor, African-Americans, Hispanic-Americans, the under educated, and women need President Obama to continue fighting for us and his agenda.

President Obama can’t get weary and give up and we can’t get weary and give up either. We must trust God and know that just like He delivered the children of Israel He will protect and deliver us too. We can't behave like the children of Isreal in Exodus 14:12 of King James Version of the Bible: “Is not this the word that we did tell thee in Egypt; saying Let us alone, that we may serve the Egyptians, than that we should die in the wilderness.”

In the meantime we need the Democratic Party to fight for us and President Obama as hard as the GOP are fighting CHANGE in the Whitehouse, politics, and President Obama.  High ranking politicans of all parties needs to called the GOP out for RACISM just like President Carter did during President Obama's 2008 term.

In addition to the GOP opposition being racist the GOP is using the budget and Obamacare to deny the passing of  a Immigration Reform bill. They know that Glenn Beck was correct when he said that Immigration Reform and/or the Hispanic and African-American vote would keep the Republican Party out of the White House and a minority in Congress for the next 30 or 40 years.

Senator Reed needs to use the nuclear option and do filibuster reform TODAY with deliberate haste.  We can't and will not wait for the 2014 election to move this nation FORWARD.  Call Harry Reid at 202-224-3542 record your message or conversation (tell live person that you are recording the call) and post it on CNN I-Report or on social media especially twitter.


God answered the prayers of our mothers and fathers and the slaves before us with President Obama victory. Therefore, we must vote in every election including the midterms as if it’s a presidential election year.  We must also stay actively engaged in the political process and hold members of Congress, governors, mayors, and the president of the United States ACCOUNTABLE!

Lastly, I want President Obama to know that he is loved by Jesus, my family, me, and millions in this country and around the world. As a Christian I believe that  the GOP hearts have been harden, just like God harden Pharaoh’s heart and the Egyptians pursued the children of Israel into the sea. (Chapter 14 of the book of Exodus)

I hope that the Republicans Party and many people who claim to be Christians but their actions don't support their claim will remember verse 4 of Exodus 14 - And I will harden Pharaoh’s heart, and he will pursue them. But I will gain glory for myself through Pharaoh and all his army, and the Egyptians will know that I am the Lord.” 

President Obama won the 2012 presidential election and the Affordable Health Care bill is the law of the law it's now time for the Republican and Tea Party to accept that fact!

On 7/20/13 President Obama asked "How do we learn some lessons from this and move in a positive direction?" Trayvon Martin's verdict was an unjust criminal verdict but African-Americans have suffered and continue to suffer from unjust CIVIL verdicts and court rulings/decisions too.

Amending the act again will allow victims of employment discrimination to have juries and not JUDGES decide if their employers discriminated and/or retaliated against them.

President Obama has supported and/or not enforeced and signed bills that have made real changes in the lives of women, the gay community, military families, and Hispanics. Afrian-Americans need real positive changes in our lives too.

By my daughter who was one of Kierra's teachers email the following to me:

Kierra “Twin” Jones was one of a kind. At just about five feet, ninety pounds, she had a huge spirit that was belying of her stature. With braids, tattoos, and oversized clothing it would be easy to look at her and assume the worst. But once she smiled, all of that melted away. And you saw her for what she was. A young woman who dared to be herself, a young woman who loved openly, a young woman who was just as quick to give an encouraging word as she was to crack a joke. And as she spoke--slow and measured, you could feel the reservoir of wisdom that was deep inside of her.

She wasn’t perfect, as none of us are. However, she was strengthened through every mistake, fortified through every failure. And throughout the revolving door that is night school, she remained constant. When her peers’ resolve weakened she said, “I have faith.”

 Twin exemplified everything that All City is supposed to represent. She dreamed through adversity. She strived every day; even in the midst of the complacency that surrounds us all. She was a leader, she was a peacemaker, so much so that it cost her life.

 And through her death, life continues. Old students are coming back through that revolving door. They’re saying they’re going to graduate for Twin. And though they may stumble, though they may never pass a Regents, or walk the stage, they have all LEARNED.

 Hopefully we too can learn from this. Our success as educators is not limited to test scores. Our success comes when we dig deep within ourselves and continue to hope. Our success comes when we look past the statistics and see our students as people who deserve dignity and respect. Our success comes when we forgive the students who disrespect and underappreciate us. Our success comes when we treat our students like we would want someone to treat our own kids. Our success comes when we don’t coddle students, but when we push them to excel. Our success comes when we lead by example.

Kierra Mae Jones 5/14/13 Murder: Racism to Maintain the Prevailing Order by Supplying AND Selling Illegal Guns to Blacks to Murder Each Other




--> On May 14, 2013, Kierra Mae Jones, who was 20 years old and a student of my 29 year old daughter was gunned down in Rochester, NY. According to the Democrat and Chronicle website Jones was celebrating the graduation of two of her cousins at her aunt’s home on York Street on May 14, 2013, when two vehicles approached.
Their occupants fired multiple gunshots and drove away. Jones, herself set to graduate from All City High in a month, was struck multiple times and died at Strong Memorial Hospital a short time later, her family said. The day before Kierra Jones was murdered my youngest daughter called me in Houston to tell me that Kierra Mae Jones watched one of my Youtube videos on racism as part of one of her assignments. On May 15, 2013, I read a haunting and provocative Huffington Post article titled “The Reactionary Nature of Black Politics.

In the article Pascal Robert stated “Jim Crow was rooted in economic control, not simply racism and brutality. Those were the tools used to keep the system intact.” Robert’s story has led me to believe that gun violence and the unwillingness of the GOP, Tea Party members, NRA, and others to support background checks for gun control is a form of racism to maintain the prevailing order: The time is now for African-Americans to stop being reactionary and become proactive in saving our children and OURSELVES.

We should demand action from Senator Harry Reid, the Democrats, and more importantly President Obama. President Obama can have a successful second term if Reid do filibuster reform NOW. With reform the Senate can pass a background check gun control bill. Reform will also allow the Senate to skip the delaying tactics of Rubio and GOP who don’t have any intentions of passing Immigration Reform before or especially not after the 2014 elections.

Filibuster reform will also allow the Senate to confirm President Obama nominated federal judges that have lifetime appointments over the GOP unprecedented opposition. At the end of his article Roberts asks who is up to the task to provide a new politics that is not rooted in reactionary response to racism but seeks to foster cross-racial coalitions with those similarly situated to crush the barriers to economic equality. My answer is PRESIDENT BARACK OBAMA!

I am so glad that President Obama's comment on the Trayvon Martin's murder and jury verdict.  Our president message encouraged us and will motivate us to greatness.

Open Letter to President Obama HELP ME: Employment Discrimination Hurts, Kills, and Destroys Victims


Updated 1/1/16 I Pray that President Obama will use his 1/12/16 SOTU Address to discuss employment discrimination and RACISM. If President Obama looks racism in the face and doesn't blink it will help GOTV for Hillary Clinton in 2016.



Updated August 27, 2015, RIP Alison Parker and Adam Ward--- Bryce Williams shooting and murdering people was unacceptable and wrong even if he was a victim like me of employment discrimination and retaliation.

                 

I am the mother of a Marine who served this country for four years as a military police officer. My son is currently a police officer. I am also an African-American woman who was unjustly terminated by New York State Department of Correctional Services on November 2, 1998, after filing an employment discrimination lawsuit on October 15, 1997.
 I believe that former LA cop Christopher Dorner’s and Bryce Williams deadly ordeals, my personal employment discrimination experience and legal case, and your 2012 reelection make this a perfect time to address employment discrimination. One of the possible ways that you can address this issue which I believe contributes to the high unemployment rate in African-Americans communities is to assemble a council or board to address and investigate employment discrimination in this country.

Bryce Williams ( Vester Flanagan) and Christopher Dorner’s inexcusable reaction to their alleged employment discrimination was to KILL. In the end both Flanagan and Dorner also died for work related interactions that they labeled employment discrimination. 

My appropriate but unsuccessful reaction to my three-year hostile work environment and four-year Pro-Se legal battle against Eliot Spitzer and his staff was to seek legal redress. I appealed the dismissal of my case by the District Court to the Second Circuit Court of Appeals and the United States Supreme Court. The Court refused to review it. The US Supreme Court got my case wrong just like they did in the Citizen United case.


I wrote a book that includes direct evidence including original documents uploaded as pictures that proves my allegations of discrimination and retaliation. I mailed copies of the original book titled "A Case of Employment Discrimination and Retaliation Real or Imagined" to you and Eric Holder.


 I created blogs, contacted Buffalo New York District Attorney, who confirmed that Spitzer filed perjured declarations, and in 2005 emailed documents to 2 United States Justice Department attorneys, who referred the case to the FBI after confirming that declarations and/or depositions in case were perjured. Despite the direct evidence that supported perjury George W. Bush Justice Department didn't charge anyone with perjury in my case.

I contacted print, radio, and television media personalities, posted videos and reports on CNN-I-Report and Youtube that highlighted it.  I matched with Al Sharpton and Martin Luther King III for Jobs and Justice on October 15, 2011, in Washington, DC. I voted for you in 2008 and volunteered as a Vote Corps volunteer for OFA at my own expense in  Norfolk, VA for your successful 2012 reelection.




I hoped and prayed that someone will give my story a voice. I prayed that you would use my story and case to make America a more just nation by helping racial employment discrimination victims. 

My prayer today (January 1, 2016) is that you will finally acknowledge that you are aware of all of my efforts. That you will use your last State of the Union to address the fact that my case is an undeniable example of employment discrimination.

You can help change hearts and minds about racism by telling nation that employment discrimination in many cases is REAL. You can tell them to read many of my blogs or book to view the evidence for themselves.

My FACTUAL allegation is that Attorney General Eliot Spitzer filed seven (7) perjured declarations in a district federal court. All of the following people employed by New York State signed their respective perjured declarations: Mike Russo, New York State Assistant Attorney General (who is still employed by NYS AG office), Gerald Goncalves (Hispanic male), Diversity Management, Superintendent Anginell Andrews (African-Amer), Sergeant William Reed (White male), James Berbary (White male), and Deputy Superintendent of Administration, and Lee Gould, (Jewish?)Director of Personnel have never been held accountable for committing the crime of perjury. 

New York State Assistant Solicitor Generals Nancy A. Spiegel and Denise A. Hartman Appellant's Brief to the Second Circuit Court of Appeals Court also contained perjured statements. One of the lies presented several times in the brief was that I was terminated December 7, 1998. The Defendants admitted in their answer to my February 19, 1999, that I was terminated on November 2, 1998. 

In their Brief Hartman and Spiegel purposely deceived the court when discussing the January 29, 1999, court order that granted my motion to amend my complaint to include the retaliatory November 2, 1998, termination. Their brief  just like Spitzer's summary judgment Memorandum of Law and declaration of Mike Russo contained the perjured statement that I was terminated on December 7, 1998.

As of today’s date September 1, 2015,  (February 11, 2013 original date of post), none of my actions have been successful in giving me peace, justice, clearing my name, receiving entitled disability retirement benefits, and/or getting you to amend Civil Rights Act 1964 or address the destructive role that employment discrimination plays in Black lives.

Unlike BORNER I believe in God and Jesus and that belief has keep me sane and HOPEFUL that I will be VICTORIOUS in this matter. I hope and pray that my 18 year extremely emotional and financial painful ordeal will lead to you President Obama signing another employment discrimination Executive Order to amend the Civil Rights Act of 1964 again.

Mr. President, the first bill you as president was Lilly Ledbetter Fair Pay Act. That bill was a victory to mostly white women. Is it possible to amend Title VII with an Executive Order? If it is will you sign another Executive Order using my case to justify your action to help other African-Americans employment discrimination victims from being victimized again by the judicial system. 

Employers shouldn't be rewarded for unlawful Title behavior with a summary judgment order.  More importantly victims of unlawful discrimination and retaliation shouldn't have their cases unjust dismissed at the district court level. One federal judge shouldn't have the absolute authority to dismiss Civil Rights Act of 1964 Title VII cases based on summary judgment motions.


I am aware of the fact that " the salutary purpose of summary judgment—avoiding protracted, expensive and harassing trials --apply no less to discriminatory cases than to commercial or other areas of litigation" Meiri v Dacon, 759 F.2d 989, 998 (2d cir.), cert. denied, 474 U.S. 829 (1985).

The salutary purpose of summary judgment and the rights of all Americans to fair and equal justice can both be accomplished with a well written and defined amendment to Title VII of the Civil Rights Act of 1964. Amending the Civil Rights Act again would prevent one judge from having the absolute power to grant summary judgment motions that dismiss Title VII (discrimination and retaliation) cases and victims right to a jury trial.
